1. Introduction

These Terms and Conditions ("Terms") govern the rental of vehicles from Diran EV Fleet Solutions Limited ("we", "us", "our", "Diran Fleet"), a company registered in England and Wales (Company No. TBA), to licensed private hire drivers ("you", "the Driver").

By submitting an application or entering into a vehicle rental agreement with us, you agree to be bound by these Terms. If you do not agree, you must not use our services.

2. Eligibility

To rent a vehicle from Diran Fleet, you must:

  • Hold a valid Transport for London (TfL) Private Hire Driver's Licence
  • Hold a valid UK driving licence
  • Be at least 21 years of age
  • Hold your own Private Hire Vehicle (PHV) insurance policy
  • Have a satisfactory driving record as assessed by us
  • Pass our vetting process including identity and document verification

3. Vehicle Rental

3.1 Rental Agreement

Upon acceptance of your application, we will enter into a rolling weekly hire agreement with you. The rental is subject to weekly payments via Direct Debit through GoCardless.

3.2 Vehicle Access

Vehicle access is managed digitally via the Tesla Fleet API. You will receive digital key access upon commencement of your rental. No physical key handover is required.

3.3 Use of Vehicle

The vehicle may only be used:

  • For private hire work via TfL-licensed rideshare platforms (Uber, Bolt, Ola, FreeNow, or similar)
  • By you alone — the vehicle must not be driven by any other person
  • In compliance with all applicable laws and regulations
  • Within the United Kingdom

4. Payment Terms

4.1 Rental Payments

Weekly rental payments are collected automatically via Direct Debit. You must maintain a valid Direct Debit mandate throughout the rental period. Payment is due in advance each week.

4.2 Failed Payments

If a payment fails, we will notify you and attempt to collect again. Continued payment failures may result in suspension or termination of your rental agreement and recovery of the vehicle.

4.3 Security Deposit

A security deposit may be required before vehicle handover. This deposit will be held for the duration of your rental and returned (less any deductions for damage or outstanding charges) within 14 days of vehicle return.

5. Your Responsibilities

You are responsible for:

  • Maintaining valid TfL licensing throughout the rental period
  • Maintaining valid PHV insurance at all times
  • Keeping the vehicle clean, both internally and externally
  • Reporting any damage, accidents, or mechanical issues immediately
  • Charging the vehicle appropriately and not allowing the battery to deplete to critical levels
  • Paying all fines, penalties, congestion charges, and parking fees incurred during your rental
  • Returning the vehicle upon termination of the agreement in the condition it was received

6. Insurance

You must hold your own comprehensive PHV insurance policy that covers you to drive the rental vehicle for private hire purposes. Proof of insurance must be provided before vehicle handover and upon each renewal.

We do not provide insurance. Any damage not covered by your insurance policy remains your responsibility.

7. Damage and Accidents

In the event of an accident or damage to the vehicle, you must notify us immediately and provide a full report including photographs. You must also report any incident to the police if required by law.

You are liable for all damage to the vehicle unless caused by normal wear and tear. This includes damage caused by third parties if you are unable to recover costs from them.

8. Termination

8.1 By You

You may terminate your rental agreement by giving us at least 7 days' written notice and returning the vehicle in satisfactory condition.

8.2 By Us

We may terminate your rental agreement immediately if:

  • You breach any material term of these Terms or your rental agreement
  • You fail to make payment when due
  • Your TfL licence or driving licence is revoked or suspended
  • Your insurance lapses or is cancelled
  • You use the vehicle in an unlawful manner
  • We reasonably believe the vehicle is at risk

8.3 Vehicle Recovery

Upon termination, you must return the vehicle immediately. We reserve the right to remotely disable vehicle access and recover the vehicle if it is not returned. Costs of recovery will be charged to you.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including loss of earnings, arising from your use of our vehicles or services.

Our total liability to you for any claim arising under these Terms shall not exceed the total rental payments made by you in the three months preceding the claim.

10. Data Protection

We collect and process personal data in accordance with our Privacy Policy. By using our services, you consent to such processing and warrant that all data provided by you is accurate.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be notified to you via email or through the driver portal. Continued use of our services after such changes constitutes acceptance of the updated Terms.
